Acceptable Use Policy

1. Scope
This Acceptable Use Policy applies to customers’ and other end users’ use of all services (Services) offered by Xplor Technologies, LLC or its affiliates (Xplor).
2. Violations
A customer’s or other end user’s violation of this policy will be considered a material breach of the master agreement or other agreement governing customer’s and/or end user’s use of the Services.
3. Content Restrictions
Customers may not, and may not permit any third party, including end users, to use or allow the use of any Service to display, store, process or transmit inappropriate material as determined by Xplor in its sole discretion, including but not limited to:
- Unlawful content in violation of any federal, state, national or international laws or regulations;
- Information about illegal activities, physical harm or injury to any group, individual, institution or property;
- Materials that infringe or misappropriate a third party’s intellectual property or proprietary rights;
- Hate-related or violent materials, and/or material advocating discrimination against individuals or groups;
- Obscene, excessively profane material or otherwise objectionable material;
- Pornographic, graphic or objectionable content including but not limited to nudity and depiction of drug use;
- Harmful, defamatory, threatening, offensive, inaccurate, abusive, harassing, or otherwise inappropriate language, including without limitation, bigotry, racism, discrimination, hatred, or profanity;
- Material advocating or advancing criminal hacking, cracking or phishing;
- Material related to illegal drugs or paraphernalia;
- Malicious materials;
- Unlawful software;
- Malicious code, such as viruses, worms, time bombs, trojan horses, cancelbots, or other computer programming routines, or other harmful or malicious files, scripts, agents or programs;
- Material that violates, encourages, or furthers conduct that would violate any applicable laws, including any criminal laws, or any third-party rights, including publicity or privacy rights;
- Materials containing medical, mental or emotional diagnosis, advice or treatment, emotional advice, medical dietary advice or personal advice of any kind;
- Advertising, promotional materials or information commercial in nature or inappropriate based on the applicable subject matter;
- Comments that do not address the content, reviews, ratings or contains no qualitative value; or
- Language intended to impersonate other users (including names of other individuals) or offensive or inappropriate user names or signatures.
4. Prohibited Actions
Customers may not use the Services, nor allow its end users or any third party to use the Services:
- for any purpose that is illegal, fraudulent or prohibited by this Acceptable Use Policy, any terms and conditions contained in an agreement with Xplor or any applicable law;
- in a way that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services, or that could damage, disable, overburden, or impair the functioning of the Services;
- with any robot, spider, crawler, scraper, or other manual or automated means or interface to access the Services, retrieve, index, scrape, “data mine” or otherwise gather content or extract user’s information;
- to use or develop any third-party applications that interacts with the Services or users’ content or information without Xplor’s written consent;
- to solicit login credentials from another user;
- to use or attempt to use another user’s account, username, or password without their permission;
- to impersonate Xplor, any employee of Xplor, another user, or any other person or entity or otherwise misrepresent any affiliation, endorsement, or sponsorship between customer or end user and Xplor, and/or any other person or entity;
- to upload viruses or other malicious code or otherwise compromise the security of the Services;
- to attempt to circumvent any content-filtering techniques Xplor employs, or attempt to access areas or features of the Services that customer or an end user are not authorized to access;
- to probe, scan, or test the vulnerability of the Services or any system or network;
- for any unauthorized purpose, including but not limited to, the purpose of building a product or services which are capable of competing for business with the Services or for similar competitive purposes;
- to copy, duplicate, modify, create derivative works from or distribute all or any portion of the Services;
- any attempt to reverse compile, disassemble, reverse engineer or otherwise reduce to human-perceivable form all or any part of the Services;
- to attempt to obtain or to gain, or assist third parties in obtaining or gaining, unauthorized access to the Services, to any related systems or networks, or to any information relating to the use of the Services;
- to carry out unauthorized invisible processing when using the Services (including placing web bugs and other monitoring devices on computers accessing the Services);
- to encourage or promote any activity that violates any terms of the applicable agreement;
- to create or post any content, including user content, that is in violation of the Content Restrictions specified herein;
- to upload, transmit, send or cause to be sent any advertising or promotional material, including any spam, junk mail, chain letters, or similar solicitation without receiving prior affirmative consent from the end user;
- to generate or facilitate SMS, MMS, or other text messages or push notifications in violation of the Telephone Consumer Protection Act, the Do-Not-Call Implementation Act, or any other applicable law in any jurisdiction including anti- spam, telemarketing, or telephone consumer protection laws or regulations;
- to conduct or forward multi-level marketing, such as pyramid schemes and the like;
- to engage in or promote gambling, or run a gambling operation;
- in any way to remove any copyright, trademark, or other proprietary rights notices contained in or on the service or reformat or frame any portion of the web pages that are part of the Service’s administration display;
- to transact online sales of firearms and/or related accessories;
- in any manner to disparage Xplor or its Affiliates; or
- to assist another to perform the acts prohibited in this Acceptable Use Policy.
Customers must use best endeavors to prevent any unauthorized access to, or use of, the Services and/or any information or data contained in or derived from it, and notify Xplor promptly of any such unauthorized access or use.
